Terms of Service

FinOps Maturity Assessment Platform — Effective date: 23/04/2026 — Version 1.0

1. Acceptance of Terms

By accessing or using the FinOps Maturity Assessment platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

These Terms apply to all users, whether accessing the Service as an individual or as a representative of an organisation. If you are accessing the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. About Us

The Service is operated by:

References to "FinOpsAlly", "we", "us" or "our" in these Terms refer to FinOpsAlly.

3. Description of Service

The Service is a free web application that enables users and organisations to assess, track and improve their FinOps maturity level against versioned blueprints. Features include:

  • Requirement evaluations and maturity scoring
  • Maturity reports and PDF exports
  • Assessment comparisons over time
  • An optional AI-powered copilot assistant

The Service is hosted on Microsoft Azure App Service (European region). It is provided free of charge and without any subscription or payment obligation.

4. Access and Authentication

Access to the Service is provided through one of the following methods:

  • Anonymous access: Users may complete assessments without creating an account. Data may not be persisted and may be lost when the session ends.
  • Email-based authentication: Users provide an email address and receive a one-time code. This allows temporary or persistent storage of assessment data linked to that email address.
  • Microsoft Entra ID (Azure AD) via OpenID Connect (OIDC): Typically used by organisations accessing the Service through their own tenant.

You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. FinOpsAlly is not liable for any loss or damage resulting from unauthorised access to your account.

5. Multi-Tenant Data Isolation

The Service operates on a multi-tenant model. Each client organisation ("tenant") has its own logically isolated workspace. Users may only access data, assessments and reports belonging to their own tenant.

Any attempt to access, probe or extract data belonging to other tenants is strictly prohibited and will result in immediate termination of access. FinOpsAlly retains full administrative access to the Service for operational and support purposes.

6. Permitted Use

The Service is intended solely for FinOps maturity assessment purposes. You agree not to:

  • Use the Service for any purpose unrelated to FinOps assessment;
  • Attempt to reverse-engineer, decompile, scrape or probe the Service or its infrastructure;
  • Upload or input unlawful, harmful, defamatory or infringing content;
  • Share access credentials with unauthorised individuals;
  • Circumvent or attempt to circumvent any security, access control or authentication measure;
  • Use automated tools, bots or scripts to interact with the Service without prior written consent;
  • Use the Service in any manner that could damage, overload or impair its availability.

FinOpsAlly reserves the right to suspend or permanently terminate access for any user or organisation found to be in breach of these terms.

7. AI Copilot Feature

When enabled, the AI copilot feature transmits relevant assessment context — including requirement descriptions and evaluation notes scoped to your tenant — to a third-party AI language model provider based in the United States for processing.

Important notices regarding the AI feature:

  • Use of the AI copilot is entirely optional and requires your explicit consent before activation.
  • AI-generated responses are provided for informational purposes only. They may be inaccurate, incomplete or biased and do not constitute professional, financial, legal or technical advice.
  • You must not rely on AI outputs as a substitute for qualified professional judgment.
  • Data transmitted to the AI provider is subject to that provider's data processing terms. Please refer to Section 4 of the Privacy Policy for further detail on international data transfers.
  • FinOpsAlly disclaims all liability arising from reliance on AI-generated content.

8. Exported Reports

The Service allows export of assessment reports in PDF format. Once a report is downloaded, you are solely responsible for its storage, handling and distribution. FinOpsAlly accepts no liability for any unauthorised disclosure or misuse of exported reports after download.

9. Intellectual Property

All platform content, including but not limited to FinOps blueprints, scoring methodologies, framework materials, user interface design and underlying software, is the intellectual property of FinOpsAlly or its licensors, and is protected by applicable copyright, trademark and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service and its content strictly for internal organisational assessment purposes. No ownership rights are transferred to you under these Terms.

You must not reproduce, redistribute, sublicense, sell or create derivative works from any platform content without prior written consent from FinOpsAlly.

10. Service Availability

The Service is provided on a free, "as is" and "as available" basis. FinOpsAlly makes no guarantees of uninterrupted, error-free or secure operation. We may perform maintenance, updates or changes to the Service at any time and without prior notice.

No service level agreement (SLA) is provided. FinOpsAlly shall not be liable for any loss or inconvenience arising from downtime, interruptions or data unavailability.

11. Disclaimer of Warranties

To the fullest extent permitted by applicable law, FinOpsAlly disclaims all warranties, whether express, implied or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose and non-infringement. The Service is used entirely at your own risk.

12. Limitation of Liability

To the fullest extent permitted by applicable law, FinOpsAlly shall not be liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to loss of data, loss of revenue, loss of business opportunity or business interruption, arising out of or related to your use of or inability to use the Service.

As the Service is provided free of charge, FinOpsAlly's total aggregate liability to you for any claim arising under or related to these Terms shall not exceed €100.

13. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable by a court of competent jurisdiction, that provision shall be deemed modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.

14. Modifications to the Service and Terms

FinOpsAlly may update or modify the Service or these Terms at any time. Where changes are material, we will endeavour to provide reasonable notice, such as a notice displayed within the Service. Continued use of the Service after any such changes constitutes your acceptance of the updated Terms.

We recommend reviewing these Terms periodically. The current version and effective date are always shown at the top of this document.

15. Termination

FinOpsAlly reserves the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or applicable law.

You may cease using the Service at any time. Upon request, we will delete your account data in accordance with our data retention practices described in the Privacy Policy.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of Portugal and applicable European Union regulations, including the General Data Protection Regulation (GDPR).

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Portugal. If you are a consumer, you may also have the right to bring proceedings in the courts of your country of residence under applicable EU consumer protection law.
